4. In-App Purchases and Virtual Items

The Services may offer in-app purchases, virtual currency, virtual items, or other digital content ("Virtual Items"). In-app purchases are processed by Google Play or the applicable app store and are subject to that store's terms and policies.

  • All purchases are final and non-refundable, except as required by applicable law or the relevant app store's refund policy.
  • Virtual Items have no real-world monetary value and cannot be exchanged, transferred, or redeemed for cash or other goods.
  • We may modify, manage, regulate, control, or eliminate Virtual Items at any time, with or without notice, to the extent permitted by law.
  • You are responsible for any charges incurred through your account, including unauthorized purchases made by minors using your account or device.

If you believe you are entitled to a refund, please contact Google Play or the applicable app store directly. We do not control and are not responsible for the refund decisions of app stores.

5. Advertising

The Services may display advertisements, including personalized and non-personalized ads. By using the Services, you agree that we and our third-party advertising partners may display such advertisements. Where required by law, we will obtain your consent before showing personalized advertising.

You may be able to limit or opt out of certain personalized advertising through your device settings, in-game consent settings, or the privacy policies of our advertising partners.

6. User Conduct

You agree not to use the Services to:

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STRAWBERRY GAME AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR (B) USD $50.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless Strawberry Game and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to:

  • Your use of the Services.
  • Your violation of these Terms.
  • Your violation of any third-party right.
  • Your User Content.

15. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law. Upon termination, your license to use the Services will immediately end.

Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which Strawberry Game is established, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the courts located in that jurisdiction, unless mandatory consumer protection laws in your country of residence provide otherwise.

Nothing in these Terms affects any statutory rights you may have as a consumer under applicable law.

17. Google Play Additional Terms

If you downloaded the Services from Google Play, you acknowledge and agree that:

  • These Terms are between you and Strawberry Game, not Google LLC or its affiliates ("Google").
  • Google is not responsible for the Services or any content within the Services.
  • Google has no obligation to provide maintenance or support services for the Services.
  • In the event of any failure of the Services to conform to any applicable warranty, you may notify Google, and Google may refund the purchase price, if any, for the Services. To the maximum extent permitted by law, Google will have no other warranty obligation whatsoever with respect to the Services.
  • Google is a third-party beneficiary of these Terms and may enforce these Terms against you.
  • You must comply with Google Play's Terms of Service and applicable usage rules.

18. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of these Terms. If we make material changes, we may provide additional notice within the Services or by other appropriate means. Your continued use of the Services after the changes become effective constitutes your acceptance of the updated Terms.

19. Miscellaneous

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

These Terms, together with our Privacy Policy and any additional terms provided within the Services, constitute the entire agreement between you and Strawberry Game regarding the Services.
